CURFEW 9 p.m. on Feb. 13 until 6 a.m. Feb. 14

The County of Vance and the City of Henderson have declared a State of Emergency due to the current weather conditions. The State of Emergency includes a curfew that begins at 9PM tonight and ends at 6AM tomorrow morning.

The purpose of the curfew is due to power outages, road conditions, and the possibility of more falling trees/branches/and ice. These conditions can, especially at night, cause grave danger to our citizens and to the emergency workers.

The curfew does not apply to emergency personnel who are responding to calls, essential health care workers, utility repair workers, or any who is required to report to their place of work during the posted hours.

No Curfew Currently Planned for Vance County, City of Henderson

According to Vance County and City of Henderson officials, there is no immediate plan to enact a curfew for the duration of Governor Cooper’s Stay at Home Order, which is currently in effect through April 29, 2020.

Neighboring counties, including Warren and Franklin, have enacted curfews from 9 p.m. until 6 a.m. through the remainder of the order’s effective dates. Travel is allowed for tasks deemed as essential, including seeking medical assistance, grocery shopping and traveling to and from essential jobs.

“The answer today is no [curfew], but this virus has left us all guessing as to what tomorrow may have in store for us,” Henderson Police Chief Marcus Barrow told WIZS News.

“With the early establishment of a local State of Emergency, Mayor Ellington positioned us, as a unified governmental entity, to be able to make those decisions as the needs of our community change. We are in continuous conversation about the overall well-being of our citizens, and I believe the majority of our community has responded tremendously to the National and State Orders. If nothing else, you can always tag or describe our city as resilient.”

Vance County Sheriff Curtis Brame and Henderson Vance Emergency Management Director Brian Short confirmed with WIZS that they have not heard plans for a curfew at this time.

“Right now, there is not a curfew as long as the people are complying with the guidelines and are mindful of the State of Emergency,” Henderson Mayor Eddie Ellington stated. “I would consult with our police chief, city manager, sheriff, as well as the district attorney before we would move on a curfew. We all want to be unified and make the right decision on behalf of our citizens and business community.”

Town of Warrenton Follows County – Curfew Begins Thurs., April 9

The Town of Warrenton has declared a curfew from 9 p.m. to 6 a.m., beginning Thursday, April 9, 2020, effective through the dates of Governor Cooper’s Stay At Home Executive Order. The Warrenton Police Department will be enforcing this curfew.

During the hours of the curfew, travel is allowed for the following reasons:

1. Medical
2. Grocery Store
3. Traveling to/from an essential job

We understand that this is a small list of reasons for traveling but, we implore you to abide by this order for the protection of everyone. Our agency will be stopping vehicles and pedestrians during this time of curfew.

The Warrenton Police Department wants everyone to be safe, and we will get through this as a community if everyone does their part by adhering to the laws. Also, be advised that during this time, the WPD is and will continue to enforce all traffic laws.

Warren County Commissioners Enact a Curfew Beginning Thurs., April 9

At the April 6, 2020, Warren County Board of Commissioners meeting, officials unanimously voted to amend the March 15 State of Emergency declaration to include a curfew for Warren County residents, as well as the towns of Norlina and Macon, beginning Thursday, April 9 at 9 p.m.

The 9 p.m. – 6 a.m. curfew will run for the duration of Governor Cooper’s Stay At Home Executive Order 121.

“Now is not the time for us as a Warren County community to be relaxed,” stated Chairman Tare “T” Davis, leading into the board’s consideration of a curfew. “We need to come together to keep each other safe. This means we must observe the Governor’s stay at home order, and we must practice social distancing.”

On April 6, the Warren County Health Department received confirmation of the county’s third known confirmed positive case of COVID-19 in Warren County. As of April 6, the county has forty-one known residents who have been tested for COVID-19; of those forty-one tests, there have been thirty-eight known negative results.

Dr. Margaret Brake, Director of the Warren County Health Department, stated that the role of the health department in positive cases is to be involved in contact tracing for those individuals that have tested positive; health department staff is also involved in isolation and quarantine orders for those positive individuals. The health department has a responsibility for checking in with those positive persons and determining when their case has recovered and when insolation orders can be lifted.

County Manager Vincent Jones clarified that the curfew would not prevent residents from conducting essential business and making essential trips as provided for in the governor’s executive order. He also stated that surrounding counties -including Franklin and Halifax – also have the 9 p.m. – 6 a.m. curfew.

County Attorney Hassan Kingsberry stated that the guidance from the Governor’s Office for essential employees traveling after 9 p.m. and prior to 6 a.m. is to have your work identification, such as an ID badge, handy while commuting. Law enforcement will work with you as long as your reason for traveling past the curfew is related to essential business as outlined in the governor’s order.

“Now is not the time to become relaxed because the weather is changing… We have seen instances of people holding gatherings of larger than ten people – cookouts – while not observing social distancing,” stated Chairman Davis. “We understand we have major holidays coming up… this is not the time or the year for that, unfortunately. Teens are playing basketball and hanging out in groups. We have to take this seriously. Community spread is here. As a rural community with less access to medical resources, it is important that we recognize the seriousness of this pandemic. We have to do this together.”

Sheriff Johnny Williams joined the meeting via telephone and stated that the Sheriff’s Office will be working with the public to help enforce the curfew. If residents see a large gathering, they should call the 911 non-emergency line at 252-257-3456 and a deputy will respond.

The Town of Warrenton passed its own State of Emergency declaration; they will consider amending their own order should they chose to enact a curfew.

Youngsville Mayor Says Franklin’s Curfew Shall Not Apply There

Shortly after 4 p.m. today, Franklin County amended its proclamation of a State of Emergency and issued a curfew.  The Franklin County curfew is scheduled to begin at 9 p.m. Sunday.  (Click here for that news story.)

Just after 5:15 p.m. today, the Mayor of Youngsville, Fonzie A. Flowers, wrote an email addressed to Franklin County Commission Chairman Sidney E. Dunston of which WIZS News was a recipient.

Flowers wrote:

“Good afternoon. In response to the curfew provision of the attached proclamation, I would very respectfully like to clarify the county’s curfew shall not apply in the corporate limits of the Town of Youngsville and the town has no intention of instituting a curfew at this time.

“Thank you for your continued service to our community.”

Subsequently, Flowers explained to WIZS News by way of telephone any number of pitfalls with this for the Town of Youngsville and took exception to the manner in which the proceedings were handled.

In an email to WIZS News, the Youngsville Town Administrator, Phillip D. Cordeiro, indicated “the towns of Louisburg and Franklinton have shared they do not intend to participate in the county’s curfew either.”

Mayor Arthur Wright in Franklinton told WIZS News, “And that’s true for Franklinton also.  We are not enforcing any curfew.”

If you will be driving through these areas for essential reasons, you should be mindful of the discrepancies within Franklin County as well as the differences, at least at this time, with the greater surrounding area.

Franklin County to Impose Curfew Effective Sun., April 5

A public safety curfew will be imposed within the County of Franklin, NC daily from 9 p.m. until 6 a.m., beginning Sunday, April 5, 2020, at 9 p.m. and extending through the effective dates of the Governor’s Stay at Home Order (Executive Order 121) and any extensions enacted for that order for all persons.

During the effective curfew period, all persons except for those who are expressly exempt as essential businesses or operations as identified within the Governor’s Stay at Home Order (Executive Order 121), shall not be or travel upon any public street, alley or roadway or upon public property, unless in search of medical assistance, food or other commodity or service necessary to sustain the well-being of him/herself or his/her family.

CITY OF HENDERSON, NORTH CAROLINA
DECLARATION OF A STATE OF EMERGENCY

WHEREAS, the City of Henderson is under in imminent threat and receiving current damage from Hurricane Michael and,

WHEREAS, as a result of the above-described disaster, I have determined that there is an imminent threat of, or existing conditions have caused or will cause, widespread or severe damage, injury, or loss of life or property, and public safety authorities will be unable to maintain public order or afford adequate protection for lives or property; and

WHEREAS, declaring a State of Emergency and imposing the restrictions and prohibitions ordered herein is necessary to maintain order and protect public health, safety, and welfare, and to secure property.

NOW, THEREFORE, pursuant to the authority vested in me as the Mayor of the City of Henderson under Article 1A of Chapter 166A of the North Carolina General Statutes and Title II Chapter 10-8 of the City of Henderson Code of Ordinances:

Section 1. A State of Emergency is hereby declared within the jurisdiction of the City of Henderson.

Section 2. The emergency area covered by this state of emergency shall be the entire corporate limits of the City of Henderson.

Section 3. The following restrictions and prohibitions are imposed:

Curfew: Imposed on the entire corporate limits of the City of Henderson, specifically beginning on this day, October 11, 2018, during the times from 11:00 P.M. to October 12, 2018 at 7:30A.M. Emergency public safety, essential medical personnel, and personnel necessary to restore power and services to the City of Henderson are not subject to this curfew.

Business Operations: All businesses within the corporate limits of the City of Henderson shall adhere to the hours described above unless deemed essential by the public safety personnel of the City of Henderson.

Section 4. I hereby order all City of Henderson law enforcement officers and employees and all other emergency management personnel subject to our control to cooperate in the enforcement and implementation of the provisions of this Declaration, all applicable local ordinances, state and federal laws, and the City of Henderson Emergency Operations Plan.

Section 5. I hereby order this declaration: (a) to be distributed to the news media and other organizations calculated to bring its contents to the attention of the general public; (b) to be filed with Clerk to the City of Henderson City Council and (c) to be distributed to others as necessary to ensure proper implementation of this declaration.

Section 6. This declaration shall take effect on October 11, 2018 at 11:00 P.M. and shall remain in effect until modified or rescinded.
