Henderson Police Chief Barrow, District Attorney Waters Discuss Recent Homicides, Issues Facing Police Department

Henderson Police Chief Marcus W. Barrow and District Attorney Michael D. Waters, with the 9th Judicial District, recently spoke on-air with WIZS to provide updates on their respective offices and discuss the recent uptick in homicides in Vance County.

According to Barrow, the most recent homicide cases, which took place in two separate incidents on Harrell Street and Merriman Street in Henderson, are still part of an ongoing investigation.

The District Attorney’s Office has been involved in all of Henderson’s 2018 homicides, according to Waters, and often works in collaboration with the police department, Federal Bureau of Investigation (FBI) and highway patrol to solve such cases.

“My office tries to get involved early in order for the cases to go to trial sooner,” said Waters.

The recent rise in homicides and the level of investigation such cases require makes the department’s personnel shortage that much more concerning. According to Barrow, the Henderson Police Department is currently down by 13 law enforcement agents – roughly 20 percent of the department’s workforce.

“What hurts the most is that we are losing experienced officers,” Barrow said. “We predicted this issue last year when I went before council and requested pay raises in an effort to right the ship and fix the issues.”

Barrow stated that he does not feel that the problem was handled quickly enough, resulting in officers taking higher paying jobs with better benefits in other towns.

Waters further explained that the shortage of personnel is not unique to Henderson and Vance County, but is currently a state-wide issue. “Most law enforcement agencies in the 9th District and all over North Carolina are looking to hire right now. There are shortages in police departments, FBI and in the highway patrol,” Waters said.

According to Waters, this shortage is due, in part, to a smaller pool of available certified law enforcement officers. “Fewer candidates available for law enforcement positions makes jobs more competitive,” said Waters.

Such staff reductions have necessitated a review of police department policies and priorities to determine how and when a call is handled. “If you have a larceny, for example, that occurs and the person has already left, you might receive a phone call [instead of a visit],” said Barrow. “Non-emergency calls may have to be put on the back burner.”

In addition to staff turnover, the police department is also short on available personnel when an officer is involved in a lengthy investigation.

“Police officers often get tied up in the investigation of cases and that is an additional drain on available personnel,” Waters said. “We need to be conscious of using officers’ time wisely in court.”

According to both Barrow and Waters, one way in which the public can assist the police department and help with the issue of crime in the community is to serve jury duty.

“Over the last year in Vance County, we have attempted to try cases and have run out of available jurors several times,” said Waters. “One thing people can do to help is to serve and participate when they receive their notice of jury duty.”

Barrow believes the current relationship between law enforcement and the District Attorney’s Office benefits the community and helps solve cases faster. “What Mike Waters has created with the District Attorney’s Office and law enforcement in the 9th District is amazing and has greatly improved our relationship,” Barrows said.

Waters credits that collaboration with quick convictions, “This year we’ve tried two murder cases and gotten two convictions which we’re very proud of and demonstrates the hard work of the offices involved with those cases.”

In order to be successful, Barrow believes those interested in joining the police department should possess, “maturity, a love for the community, an interest in investigation, the ability to see cases through to their conclusion, a calm mind and a level head.”

A passion for the job and serving others also helps. “Law enforcement is a career where you have to love what you’re doing and stay the course,” said Barrow. “I’ve been doing this for 20 years and I can’t imagine doing anything else.”

2 Arrested and Charged with Nancy Alford’s Murder

In a press conference today, District Attorney Mike Waters announced the arrest of two suspects related to the Nancy and John Alford murder and arson case in Warren County.

“Orders for arrest have been served on two individuals in this matter for the death of Nancy Alford.  They are Kevin Munn and Lester Kearney, and they are now committed to the custody of the Warren County Sheriff.  They are charged for the first-degree murder of Nancy Alford.  Other charges will be pending and being served in the coming days as this investigation continues to unfold,” Waters said.

He said, “They are presumed innocent until proven guilty in a court of law, but I just again would reiterate what a pleasure it has been to work with such professional and competent law enforcement agencies across the state, particularly to see people just so committed and to work countless hours in this matter.  Again, deepest sympathies to this family and this community for their loss.”

Local and state law enforcement agency cooperation since the incidents occurred last Friday aided in the apprehension of the suspects.

Waters said both suspects “were taken into custody in this community.”  One was arrested in Warren County and the other in Halifax County.

The Mercedes vehicle owned by the couple was recovered after it was abandoned in Haywood County.

Waters said, “This was a robbery.”  He said, “I think they knew of the couple.”

He said the suspects were not authorized for release under any bond.

Officer Involved Shooting Follow Up

Press Release

Henderson, NC- On Saturday, November 18, 2017, the District Attorney’s Office was contacted by Chief Marcus Barrow of the Henderson Police Department, regarding an officer involved shooting. Chief Barrow asked for our assistance in requesting the North Carolina State Bureau of Investigation (SBI) conduct an investigation into the incident. The SBI promptly arrived and began processing the scene for forensic evidence and conducting interviews. The SBI preliminarily reported to our office that they concluded evidence collection as of late Saturday evening, but were continuing with interviews of witnesses today.

The District Attorney’s Office will await the results of the SBI investigation before making any determination about whether the use of force was appropriate.

Three individuals have been charged with respect to the incident that preceded the officer involved shooting. Randolph Jones, Jr. and O’Sha Dyshon Jones are in the currently in the custody of the Vance County Sheriff’s Office. A warrant for the arrest of Devontay D. Richardson remains unserved. This is a pending investigation and these defendants are presumed innocent until and unless proven guilty.

HENDERSON, NC- A session of Vance County Criminal Superior Trial Court was held during the week of November 6, 2017. The Honorable Robert H. Hobgood, Senior Resident Superior Court Judge, presided over the session. The District Attorney’s Office was represented by District Attorney Michael D. Waters and Assistant District Attorneys Melissa D. Pelfrey, Nicole G. Louis and David J. Erdmann. Many cases were disposed of during the session, including the following:

Trevor Bullock pleaded guilty to Attempted First Degree Statutory Sex Offense. Judge Hobgood sentenced Mr. Bullock to a 94 to 173 month active sentence in the North Carolina Department of Public Safety, Division of Adult Correction (DAC). This case was investigated by the Office of Vance County Sheriff Peter White.

Quincy Champion pleaded guilty to Assault with a Deadly Weapon Inflicting Serious Injury. Judge Hobgood sentenced Mr. Champion to a 40 to 60 month active sentence in the DAC. This case was investigated by Detective Alan Simmons of the Henderson Police Department under the direction of Chief Marcus Barrow.

Bryant Coleman pleaded guilty to 2 counts of Assault with a Deadly Weapon and 2 counts of Discharging a Weapon into Occupied Property. Judge Hobgood sentenced Mr. Coleman to a 60 to 84 month active sentence in the DAC, followed by another active sentence of 60 to 84 months in the DAC, followed by another 25 to 42 month active sentence, which was suspended for 36 months of supervised probation. This case was investigated by the Office of Vance County Sheriff Peter White.

Vondell Gregory pleaded guilty to trafficking in heroin and manufacturing a controlled substance within 1,000 feet of a school. Judge Hobgood sentenced Mr. Gregory to a 110 to 156 month active sentence in the DAC. This case was investigated by the Henderson Police Department under the direction of Chief Marcus Barrow.

Lamarius Lewis pleaded guilty to trafficking in heroin. Judge Hobgood sentenced Mr. Lewis to a 70 to 93 month active sentence in the DAC. This case was investigated by Special Agent John Rowan of ALE.

Aaliyah Miles pleaded guilty to Common Law Robbery. Judge Hobgood sentenced Ms. Miles to a 10 to 21 month active sentence in the DAC. This case was investigated by the Office of Vance County Sheriff Peter White.

The case of State of North Carolina versus Tamar Daye was called for trial. Ms. Daye is charged with First Degree Murder in the death of Corey Cheek in May of 2016. However, this case could not be tried, because an insufficient number of jurors reported for jury duty. The case was continued and is scheduled for trial in the first half of next year.

Voluntary Dismissal With Leave in Franklin Co. Murder Case

Louisburg, NC – On Wednesday, October 11, 2017, Senior Resident Superior Court Judge Robert H. Hobgood presided over an administrative session of Franklin County Criminal Superior Court which was set by the District Attorney’s Office specifically to address the pending murder cases in Franklin County. The State of North Carolina vs. Oliver M. Funes Machada was among the cases heard before the Court. Prior to today, the Defendant was committed to Central Regional Hospital to evaluate his capacity to proceed in the criminal case against him. The Court sought guidance regarding his ability to understand the nature of the proceedings against him, and his ability to assist in his defense. The Court, after reviewing the report prepared by mental health professionals at Central Regional Hospital, determined that the Defendant did not have the capacity to proceed. Therefore, the State of North Carolina will take a voluntary dismissal with leave in this case. Oliver M. Funes Machada will be committed to Central Regional Hospital for mental health treatment and further evaluation. Should the Defendant’s capacity
to proceed be restored, he would be returned to the custody of Franklin County Sheriff Kent Winstead, and the District Attorney’s Office will reinstate the charges against the Mr. Machada.
